Burn and Scald Treatments
HealthDirect.gov has identified the following actions that can be taken to treat a scald or burn not requiring immediate professional medical attention:
- Make sure you are safe (get away from the source of heat)
- Put the burnt area under cool running water for at least 20 minutes (but don’t use ice)
- Use a hydrogel for first aid if water is not available
- Remove any clothing near the burn that is not stuck to it
- Remove any jewelry near the burn if that is easy to do
- Take painkillers like paracetamol and anti-inflammatory tablets
Proving Negligence Claims
Accidents happen, but often injuries occur because someone was being reckless and when this happens we help those who have been harmed get the compensation they deserve for their injuries. Contact us today if you or a loved one has been scalded or burned because someone else was acting reckless or irresponsibly.
To demonstrate that someone acted negligently, and is therefore responsible for compensating the injured, we must help you demonstrate several things.
- Duty of Care. We must first establish that there was a duty of care owed to the person who was injured. For example, if your child is left in the care of a babysitter, that babysitter has a duty of care towards your child and must act responsibly.
- Breach of Duty. Second, we must establish that there was a breach of the duty of care. If, for example, your neighbor allowed his or her leaf burning fire to get out of control then there was likely a breach of the duty of care your neighbor owed you and other neighbors.
- Causation. The third element that must be established is causation. This means that the we must demonstrate that the breach of duty of care is what caused you or your loved one’s injuries. We often work with a team of medical professionals to help make this determination.
- Harm. Finally, it must be shown that there was a harm suffered that is recognized under the law. A scald mark or burn certainly qualifies.
Atlanta scalds attorney James Ponton has worked with many families who have been the victim of the negligent acts of others. Don’t suffer in silence, reach out for help and let us work with you to get you and your family the compensation you are entitled to under the law.
Intentional Acts
Sadly, people often act with malice to hurt others. A victim of a scalding or burning should be compensated for their injuries if the person who caused the injuries did so intentionally. Nobody can read minds so we look at the actions and the facts and circumstances surrounding the act that caused the injury to help determine if it was intentional or not.
There are often criminal charges filed against those who intentionally burn or scald another. This is different than where someone was scalded or burned by the negligent conduct of another, in those instances there is usually no criminal prosecution.
The difference between negligence and intent is not always easy to understand or very clear. Contact Atlanta scalds attorney James Ponton to discuss your case and to learn about your options under the law.
